Privacy Notice for Prisms Products and Services

This Privacy Notice for Prisms’ Products and Services applies to the processing of personal information by Prisms of Reality, Inc. (“Prisms,” “we,” “us,” or “our”) through our VR-based learning applications, web-based dashboard, and related services (collectively, the “Services”). 

Please note that we process personal information of students (“Students”) pursuant to agreements with our customers that are educational institutions or school districts (“Schools”). Our agreements with Schools may further restrict our processing of Student personal information, but we will still process Student personal information consistent with this Privacy Notice. 

Disclosure Regarding the Children’s Online Privacy Protection Act (Direct Notice to Parents and Schools). For information on our processing of personal information that is subject to the Children’s Online Privacy Protection Act (“COPPA”), please see Annex A – Supplemental COPPA Privacy Notice.

We may update this Privacy Notice from time to time at our sole discretion. If we do, we’ll let you know by posting the updated Privacy Notice on our website, and we may also send other communications.

In addition, Schools may upload or otherwise provide personal information about their Students.

We may use personal information: (i) for other purposes that are clearly disclosed to you at the time you provide the personal information, (ii) with your consent, or (iii) as otherwise directed by you.

We share personal information with third parties for a variety of business purposes, including to provide the Services, to protect us or others, or in connection with a major business transaction such as a merger, sale, or asset transfer, as described below.

We may share any of the personal information we collect with the categories of third parties described below.

Any personal information shared with a Third-Party Service will be subject to the Third- Party Service’s privacy policy. We are not responsible for the processing of personal information by Third-Party Services.

Once your personal information is shared with our business partner, it will also be subject to our business partner’s privacy policy. We are not responsible for the processing of personal information by our business partners.

  1. Disclosures to Protect Us or Others

We may share your personal information and related information with external parties if we, in good faith, believe doing so is required or appropriate to comply with law enforcement requests, national security requests, or other government requests; comply with legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual unauthorized or illegal activity.

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, transition of service to another provider, or other similar corporate transaction, your personal information may be shared, sold, or transferred as part of such a transaction.

  1. INTERNATIONAL TRANSFERS OF PERSONAL INFORMATION

All personal information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. However, our contract with a School may restrict or limit where we can host or transfer personal information that we process on behalf of the School. In these cases, we will comply with the requirements of our contract with the School.

We store the personal information we collect as described in this Privacy Notice for as long as you use the Services, or as long as necessary to fulfill the purpose(s) for which it was collected, or as long as necessary to pursue our business purposes.

To determine the appropriate retention period for personal information, we may consider applicable legal requirements; the amount, nature, and sensitivity of the personal information; certain risk factors; the purposes for which we process your personal information; and whether we can achieve those purposes through other means.

Annex A - SUPPLEMENTAL COPPA Privacy Notice 

This Supplemental COPPA Privacy Notice (“COPPA Privacy Notice”) governs Prisms’ collection, use, and disclosure of personal information from Students under the age of thirteen in the United States (each a “Child” and collectively “Children”) when providing the Services. 

This COPPA Privacy Notice supplements the Privacy Notice for Prisms’ Products and Services and provides information about our information practices with regard to Children. Capitalized terms not defined in this COPPA Privacy Notice have the meaning set forth in our Privacy Notice. If this COPPA Privacy Notice conflicts with our Privacy Notice, this COPPA Privacy Notice will control as it relates to the collection, use, and disclosure of Children’s personal information.

For example, Schools often have students use the Services in connection with another Third-Party Service that the School uses for educational purposes. 

Any personal information shared with a Third-Party Service will be subject to the Third- Party Service’s privacy policy. We are not responsible for the processing of personal information by Third-Party Services.

  1. PARENTAL RIGHTS AND CONTROLS

Parents and Schools have the following controls over Children’s personal information for which they are responsible.

Parents and Schools may exercise these rights by sending us an email at hello@prismsvr.com. We may require you to take certain steps or provide additional information to verify your identity before we act upon your request.

Please note that if you refuse to permit us to further collect or use your Child’s personal information, or if you request deletion of your Child’s personal information, we may terminate our Services we provide to the Child.

If you request that we delete your Child’s personal information, we will delete as much information as we are legally permitted.
